Access to The Levee Free Wi-Fi network is subject to the terms and conditions set out below. By accessing and using the network you accept these terms and conditions. Maitland City Council may also review and amend these terms and conditions at any time.
Each time you access the Wi-Fi you should carefully review these terms and conditions. If you do not agree to these terms and conditions you will be prevented from accessing the Wi-Fi network.
Users must provide their own device that is capable of accessing Wi-Fi. Maitland City Council does not provide information technology advice or technical support for your device(s).
Each user is limited to 300MB of data usage or a time limit of three hours from initial connection. Once either of these limits are reached the free browsing session will be automatically terminated. After exceeding the limit the user will be unable to start a new session until 24hrs has passed since the time of their first connection.
The speed of the Wi-Fi network will vary depending on a number of factors, including but not limited to:
- The capability of your wireless enabled device (Older devices may impact the speed and/or reliability of the connection).
- The physical location of the wireless access points in The Levee Shared Zone.
- Network user traffic during time of access.
- General congestion.
- Wireless signal interference.
- Scheduled maintenance.
- Unscheduled outages.
Maitland City Council does not guarantee access to the Wi-Fi network will be continuous, fault free, secure or accessible at all times. The Wi-Fi network is not suitable for applications or use which requires continuous uninterrupted data flow.
Maitland City Council will monitor and attend to any network faults, malfunctions or other problems associated with network access however it is not obliged to rectify any such faults, malfunctions or problems associated with the Wi-Fi network within any specified timeframe.
The Wi-Fi network is intended to be used in a fair and community minded manner by visitors to The Levee. To this end Maitland City Council may limit or block certain websites and/or content which is deemed inappropriate or illegal.
The Wi-Fi network is not designed to be used by businesses in The Levee Shared Zone. Where a device is identified as abusing the system Maitland City Council in its absolute and sole discretion may block or restrict Wi-Fi network access to the devices.
To access the Wi-Fi network, you simply need to connect to the network through your devices network settings. When viewing available Wi-Fi networks the network name is ‘The Levee Free Wi-Fi’.
Once connected a landing page will be displayed in which the user must read and accept these terms and conditions. After accepting the terms and conditions and clicking the ‘Connect’ button you will be redirected to another page, titled ‘You’re Connected’ which indicates you are successfully connected to the Wi-Fi network.
To disconnect from the Wi-Fi network return to your network settings and select the option to ‘Forget this network’.
Maitland City Council will take reasonable action to provide secure access through the Wi-Fi network, however it cannot guarantee the security of the Wi-Fi network at all times.
You are solely responsible for any information or data uploaded, downloaded or otherwise communicated through this network. You are also responsible for keeping all usernames, passwords and other security based information secure and private at all times.
Without limiting any other provisions of these terms and conditions, Maitland City Council shall not, in any way, be liable to you for any loss or damage incurred as a result of your use of this Wi-Fi network, including but not limited to any viruses or malware your device may become subject to during your use of the Wi-Fi network.
Maitland City Council is committed to safeguarding personal privacy. Maitland City Council will only collect, use and store your personal information for the purposes of delivering the Wi-Fi network in accordance with applicable legislation and these terms and conditions.
Maitland City Council will collect and store the IP and Media Access Control (MAC) address of any wireless enabled device which accesses the Wi-Fi network. This information will only be collected after you have agreed to these terms and conditions and successfully connected to the Wi-Fi network.
Maitland City Council is not in any way responsible for how any third party collects and/or uses your personal information. This includes but not limited to any website, application or web service that you access and/or use through the Wi-Fi network.
Maitland City Council makes no warranties or representations as to the accessibility, security, stability or reliability of the Wi-Fi network. Maitland City Council disclaims any liability or responsibility for any Wi-Fi network faults, failures or interruptions or the accuracy, timeliness, completeness, security or reliability of any communications, any damage to, or viruses that may infect your device, or other property on account of your access to the Wi-Fi network.
You agree to indemnify and must defend and hold harmless, Maitland City Council and its personnel, from and against all loss, damage, liability, charge, expense or cost of any nature or kind arising from your use of the Wi-Fi network or a breach of these terms and conditions.
